Wilders' lawyers had petitioned for the dismissal of the case but the court rejected most of their arguments, ruling that he could be prosecuted for disseminating the Fitna film even though it was hosted on an American computer. It did, however, accept that he should no longer be prosecuted for calling the Koran a fascist book and calling for it to be banned.
